While I am mad at this bureaucratic corruption of the insurance company, I am far more perturbed by Snell's dismissal of my sister and her financial hardship from the incident. As someone with industry experience in automotive sales and repair, and due to the component failure not being anyone's fault but a rare freak occurrence, I would consider an offer of 50% of the repair bill or the total profit from the vehicle sale, whichever is less for the seller, to be a very reasonable offer of maintaining one's reputation and keeping the future business of a customer.
Snell has some good cars, and was in my mind a reputable dealer until a family member's recent experience of purchasing a Mini Cooper, naturally aspirated, manual transmission.
The vehicle suffered a catastrophic clutch plate failure, which to his credit was undetectable in any way until it was too late. The vehicle's mileage is not conducive to such a failure, and after my sister had it towed to a garage where she lives, nearly 300 miles away from Snell, a disassembly of the front drive axle confirmed failure of the clutch plate and related components. The vehicle had less than 400 miles on it from the time of purchase, and due to time constraints, the vehicle was repaired properly and a claim filed against Snell's insurance company under the NYS consumer protection lemon law. The insurance company declined the claim under the sole reason of the vehicle having already been repaired by the time of claim, even though the failed parts were kept for inspection by any interested party.
He has done neither, and does not intend to. If you're in the market for a used car, you are better off buying your car from a private seller on eBay or the classified section, because you'll receive the same amount of support in the event of a mechanical failure shortly after purchase.
